Product description...

Examining the critical legal and ethical issues surrounding medical malpractice. A comprehensive guide for healthcare professionals, patients and Attorneys.

In most medical malpractice cases, what gives rise to a breach of duty is “negligence” which is generally defined as conduct that falls short of a standard. In medical term, this is the standard of care required of a doctor in the course of his or her duty as a prudent practitioner. The most commonly used standard in tort law is that of a “reasonable person” and in a malpractice suit, the question asked is, what would a reasonable physician in similar circumstances do or not do, in order to protect the patient from a “foreseeable” risk of harm? Medical malpractice is a serious issue that affects patients, healthcare providers, and the healthcare system as a whole. It occurs when a healthcare professional fails to provide an appropriate standard of care, resulting in injury or harm to a patient. This textbook is designed to provide an in-depth understanding of the legal and ethical principles surrounding medical malpractice, as well as the strategies and techniques used to prevent and address it. The book is divided into several sections, including an overview of the legal and ethical issues in medical practice, a discussion of the causes and the elements of medical malpractice, including a review of the various strategies and defenses used on the harsh reality of malpractice suits, that puts doctors against their patients. In addition, the book includes real-world case studies and examples to help readers understand the complexities and nuances of medical malpractice. This textbook is intended for healthcare professionals, legal professionals, and students including residents in these fields. It is also a useful resource for patients and their families who may be affected by medical malpractice. The hope is that this book will serve as a valuable resource for those looking to gain a deeper understanding of this important topic that remains a dreaded impediment to patient care. The author of the book expressed his understanding of the field of medical malpractice and healthcare law, based on years of research in this particular subject. He has combined his knowledge and expertise to create a comprehensive and accessible resource that is both informative and practical. The belief is that this textbook will be an invaluable resource for anyone interested in understanding the legal and ethical principles surrounding medical malpractice, and the strategies and means used to prevent and address what to some is a minefield.
